ELIGIBILITY:

The Summer Sweeps (“Sweepstakes”) is open only to individuals who are legal residents of the province of Ontario and who are nineteen (19) years of age or older at the time of entry (unless otherwise excluded by Sponsor in accordance with applicable law), playing physically within the province of Ontario (for those entering via the Wager method (as described in Section 4 below)), and have an active, KYC verified Ontario BETMGM Sportsbook account (“BetMGM Account”). Proof of residency and age may be required. Creating a BetMGM Account at www.betmgm.ca is free. By submitting your information and creating a BetMGM Account, however, you will be required to agree to Sponsor’s Privacy Policy and Terms of Service. If you do not agree to Sponsor’s Privacy Policy and Terms of Service, you cannot create a BetMGM Account or participate in this Sweepstakes. Sponsor additionally reserves the right to refuse or otherwise restrict your eligibility to participate in the Sweepstakes for any reason, in its sole discretion, including based on your wagering patterns or wagering history. Sponsor additionally reserves the right to refuse or otherwise restrict your eligibility to participate in the Sweepstakes for any reason, in its sole discretion, including based on your wagering patterns or wagering history. “Sweepstakes Entities,” as referenced herein, shall include Sponsor, prize provider (if applicable), and each of their respective parent, subsidiary, and affiliate companies, and administrative, advertising, and promotion agencies, gaming license partners, and any other entity involved in the development, administration, promotion, or implementation of the Sweepstakes. Subject to all applicable federal, state, provincial, and local laws and regulations. Sweepstakes is void outside Ontario and wherever prohibited or restricted by law. This Sweepstakes is only open to natural persons and the following are ineligible: corporations, businesses, non-profit organizations, governmental agencies and other entities. Employees, officers, directors, members and representatives of the Sweepstakes Entities, any advertising agency or web company connected with the Sweepstakes Entities, and any members of these persons immediate families (spouse, parents, siblings and children and each of their respective spouses, children and siblings), and persons living in the same households of each of the above (whether legally related or not) are ineligible to participate in this Sweepstakes or receive a prize. The Sponsor reserves the right to verify the eligibility of all Participants. The Sponsor additionally reserves the right to refuse or otherwise restrict the eligibility of any individual to participate in this Sweepstakes for any reason, in its sole discretion, including based on Participant’s wagering patterns or wagering history.
5. Additionally, any individual with a BetMGM account on any product in one (1) or more jurisdictions where the Sponsor operates, that has been involuntarily closed, suspended (including any accounts in cool-off status), or where such account has been marked as fraudulent, is ineligible to participate in, and/or receive a prize, for this Sweepstakes even where such entrant may seek entry in this Sweepstakes through an active account in another jurisdiction.

ACTION REQUIRED:

6. How to Participate: No Purchase Necessary to Enter or Win. For each eligible entry that you submit during an Entry Period (up to one (1) entry per Entry Period), you will also automatically receive one (1) entry in the drawing for the Prize (unless you are selected as a winner of a Weekly Prize, in which case you will not receive any entries for the Prize drawing). No further steps must be taken. You may enter the Sweepstakes in any of the following ways:
   
   1. Wager Method: For each Entry Period, once you have logged into your BETMGM account in Ontario and opted into the Sweepstakes, you may earn one (1) entry by wagering at least twenty-five ($25) dollars, on any sports wager with minimum -300 odds to receive an entry. Your wager must be received by Sponsor within the applicable Entry Period in order for it to be an eligible entry for that Entry Period.
   2. Alternative Method of Entry (“AMOE”) – Mail-In Entry: Participants may earn one (1) entry by providing the Participant’s complete name, street address, city, state/province, ZIP code, daytime and evening telephone numbers (including area code), BetMGM Account user ID, and valid email address, on a plain piece of 3.5" x 5" paper, and mailing it to BetMGM Marketing, attn.: Summer Sweeps, 88 Queens Quay West, Suite 2500, Toronto, ON M5J 0B8 each week. For each Entry Period, mail-in entries for such Entry Period must be postmarked on a date that is between (and including the start date and end date of such Entry Period) and received no more than five (5) days after the end date of such Entry Period to be eligible for that Entry Period. The postmark date on mail entries will be considered the date of entry.

8. Non-winning entries during an Entry Period will not roll over to subsequent Entry Periods.
9. Limit: There is a limit of Ninety (90) entries per Participant during the Promotional Period, regardless of entry method. There is a limit of Ten (10) entries per Participant during each Entry Period, regardless of entry method. Any attempt by any Participant to obtain more than the stated number of entries, including by using multiple/different Sportsbook Accounts, identities, registrations and logins, or any other methods, will void that Participant’s entries and that Participant may be disqualified from the Sweepstakes. Use of any automated system to participate is prohibited and will result in disqualification. Entries submitted by Participants who do not meet the eligibility requirements set forth in section 1 above (including all requirements with respect to age and residence) are void. Multiple participants are not permitted to share a Sportsbook Account and/or email address relating to a Sportsbook Account.

   Each Participant must be the rightful owner of the email address and/or BetMGM Account used (the authorized account holder) to enter the Sweepstakes. The authorized account holder is deemed the natural person who is assigned to an email address by the online organization that is responsible for assigning email addresses for the domain associated with the submitted email address. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the email address and/or Sportsbook Account associated with the winning entry and that all eligibility requirements are met.

   For purposes of this Sweepstakes, an online entry is received when Sponsor’s Website’s servers record the entry information, and a mail-in entry (if applicable), when such entry is physically received by Sponsor at the address provided herein. Proof of sending (such as an automated computer receipt confirming entry or “thanks for entering” message) does not constitute proof of actual receipt of an entry for purposes of this Sweepstakes. The Website’s database clock will be the official timekeeper for this Sweepstakes. Those Participants who do not follow all of the instructions, provide the required information in their entry form, or abide by these Terms & Conditions or other instructions of e Sponsor may be disqualified. All Participants submitting materials/content as part of the Sweepstakes will be non-exclusively licensing (with the unlimited right to sublicense) to Sweepstakes Entities the right to use such materials, and the images related thereto (including entrant’s name, social media account username and likeness), for any purpose (including any and all commercial purposes) with the right to modify the materials and make derivative works thereof.

   General: All entries become the property of the Sponsor and, unless otherwise indicated herein, will not be acknowledged, or returned. Entries which are late, lost, stolen, mutilated, invalid, damaged, unreadable, tampered with, illegible, unintelligible, incomplete, misdirected, generated by a script, macro, or other automated/repetitive electronic means, that are mechanically reproduced, inaccurate, forged, and/or irregular in any way or otherwise not in compliance with these Terms & Conditions will be disqualified.

CLAIMING PROMOTIONAL OFFER:

11. PRIZE: A total of Nine (9) Prizes are offered in this Sweepstakes (each “Prize”, collectively the “Prizes”). This Prize will be awarded to nine (9) winners. This Prize consists of the following elements:

    $25,000 in cash.

Cash prizes will be provided in the form of withdrawable funds. Such withdrawable funds will not be subject to any withdrawal restrictions or expiration.

REGISTRATION PROCEDURES:

12. If you created a BetMGM online gaming account via BetMGM Casino or BetMGM Poker, you do not need to create a new account.
13. You can go to BetMGM.com or download the app and use your existing credentials to log into BetMGM Sports app.
14. All information must be valid in order for the account to be verified. You cannot place a wager until your account is verified.

18. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING. THIS SWEEPSTAKES IS VOID WHERE PROHIBITED, OR OTHERWISE RESTRICTED BY LAW. ODDS OF WINNING DEPEND ON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED. AFFIDAVIT OF ELIGIBILITY / RELEASE OF LIABILITY / PRIZE ACCEPTANCE AGREEMENT MAY BE REQUIRED FOR ANY SELECTED POTENTIAL WINNERS AS EXPLAINED MORE FULLY HEREIN.

WAGERING REQUIREMENTS/EXCLUSIONS:

ORDER OF FUNDS USED FOR WAGERING:

20. Participant who enter via the wager method will wager funds to receive withdrawable dollars. Withdrawable dollars will be credited to Participant’s account promptly (within approximately 72 hours) after accepting the Prize.

ELIGIBLE GAMES:

For participants entering via the wager method, a wager must be placed on any sports wager with minimum -300 odds.

RESTRICTIONS ON WITHDRAWALS:

21. There are no restrictions on withdrawals for this Sweepstakes.

CANCELLATION:

22. If Participant opts to cash out on Participant’s Eligible Wager early through the “Cash Out” or “Auto Cash Out” features, that participant’s wager will no longer be eligible for this Sports Promotion. If Participant opts to edit Participant’s Eligible Wager through the “Edit My Bet” feature, that participant’s wager will no longer be eligible for this Sports Promotion. If Participant opts to get Participant’s Eligible Wager canceled, that participant’s wager will no longer be eligible for this Sports Promotion.
23. Upon request for cancellation, BetMGM will inform the player of the amount of unrestricted funds that will be returned upon cancellation and the value of restricted funds that will be removed from the participant’s Account. If the participant elects to proceed with cancellation, unrestricted funds remaining in a participant’s interactive gaming account will be returned in accordance with the terms and conditions.

26. Sponsor has complete discretion over interpretation of the Terms & Conditions, of administration and operation of the Sweepstakes, and of selection of the winner(s). Decisions of the sponsor as to the selection of the winner(s) will be final and binding in all matters related to the Sweepstakes. Each selected potential winner(s) may, in sponsor’s sole and absolute discretion, be required to show a valid government-issued driver’s license, government-issued identification or other identification (subject to sponsor’s approval) as evidence of identity and/or residency. Released Parties shall not be liable to any winner or any other person for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s), ordinances(s), or request(s) by any governmental or quasi-governmental entity (whether or not the action[s], regulations[s], order[s] or request[s] prove[s] to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, epidemic, pandemic, public health emergency, severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond sponsor’s sole control (Force Majeure Event). A Force Majeure Event expressly includes (1) an outbreak or resurgence of COVID-19 (as defined by the World Health Organization, which, together with any related strains, variants and mutations thereof and other similar infectious diseases, are collectively referred to herein as COVID-19) or, (2) action, order, regulation or guidance taken or issued by a government authority in response to an actual or threatened outbreak or resurgence of COVID-19.
29. Released Parties are not responsible for and shall not be liable for: (i) any incorrect or inaccurate information, whether caused by Participants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (ii) technical, hardware, software, or telephone failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled, or delayed computer transmissions which may limit or interfere with a Participant’s ability to take part in the Sweepstakes; (iii) unauthorized human intervention in any part of the entry process of the Sweepstakes; (iv) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (v) late, lost, delayed, misdirected, incomplete, unreadable, inaccurate, undeliverable, damaged or stolen entries or notices (including winner notifications, if applicable); (vi) data corruption, theft, destruction, unauthorized access to or alternation of entry or other materials; (vii) any printing, typographical, human, administrative or technical errors or omissions in any material associated with the Sweepstakes; and/or (viii) any injury, loss, costs, expenses or damages to persons or property (including, but not limited to, damage to any computer system or mobile device related to participation in, accessing or downloading information related to the Sweepstakes) which may be caused, directly or indirectly, in whole or in part, from Participant’s participation in the Sweepstakes or any Sweepstakes related activity; and/or (ix) any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by any persons.

Except where prohibited by law, by accepting the prize, winner(s) agrees and acknowledges that Sponsor, and their designees may, without any limitation or further compensation, use his or her name, voice, biographical data and/or likeness in any and all media now known or hereinafter devised, throughout the universe and in perpetuity, for any commercial purpose including, but not limited to, advertising and promoting the Sweepstakes or any other promotion, contest or Sweepstakes sponsored by Sponsor.
31. Sponsor reserves the right, in its sole and absolute discretion, to modify, cancel or suspend this Sweepstakes (or any portion of the Sweepstakes) for any reason, including, without limitation, should an error, virus, bug, computer problem or other cause or issue corrupt, restrict, prevent or inhibit the administration, security or proper operation of the Sweepstakes and, in such situation, to select the winner from the remaining eligible non-suspect entries received prior to and/or after such action or in such manner as deemed fair and appropriate by Sponsor in its sole and absolute discretion. Sponsor may prohibit a Participant from participating in the Sweepstakes or winning the prize if, in its sole and absolute discretion, Sponsor determines a Participant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair practices or intending to annoy, abuse, threaten or harass any other Participant or Sponsor’s representatives. No more than the stated number of prizes will be awarded. ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE; SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
32. Each entrant must be the rightful owner or have authorized use of the email account associated with the entrant’s submitted email address (if provided). If a dispute arises about who submitted an entry, the entry will be deemed submitted by the authorized account holder of the BetMGM account provided. The “authorized account holder” is deemed the natural person who is assigned to an email address by an Internet access provider, service provider, or other online organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Each potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the winning entry and that all eligibility requirements are met. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible.

34. This Sweepstakes is subject to all applicable federal, state, provincial, and local laws and regulations and is void where prohibited or restricted by law.
35. No waiver of any of the provisions of these Terms & Conditions shall be deemed or shall constitute a waiver of any other provisions hereof, nor shall waiver constitute a continuing waiver unless otherwise expressly provided. If any provision of these Terms & Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms & Conditions, which will otherwise remain in full force and effect.
36. This Sweepstakes is in no way sponsored, endorsed, or administered by, or in association with any person or other entity, including any third party, other than BetMGM, LLC.

38. This Sweepstakes is intended for viewing in Ontario only and shall be construed and evaluated only according Canadian law. Do not enter this Sweepstakes if you are not located in Ontario and, more specifically, comply with eligibility requirements set forth herein. The use of any automated devices in connection with this Sweepstakes is prohibited. Sponsor assumes no responsibility for computer system, hardware, software, or program malfunctions or other errors, failures, delayed computer transactions, or network connections, whether human, technical, or otherwise in nature. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Sweepstakes should virus, bugs, or other causes beyond its control corrupt the administration, security, or proper play of this Sweepstakes. Any invalid, illegal, or unenforceable provision shall be deemed severed from these Terms & Conditions and the balance of these Terms & Conditions shall be construed and enforced as if these Terms & Conditions did not contain such invalid, illegal, or unenforceable provision.

WINNER’S SELECTION AND NOTIFICATION:

41. The drawing for each Entry Period will take place at least five (5) days after the conclusion of such Entry Period. One (1) potential winner will be selected in a random drawing by representatives of Sponsor from all eligible entries received during each Entry Period. Nine (9) potential winner(s) will be selected in total during the Promotional Period. For each Entry Period, the odds of winning the Prize associated with such Entry Period depends on the total number of eligible entries received for such Entry Period. The odds of winning the Prize depend upon the total number of eligible entries received for the Prize drawing. Selected potential winner(s) will be notified via email and/or telephone. In order to win, the selected entrant must correctly answer, unaided, an arithmetical, time-limited, skill testing question.
42. Sponsor is not obligated to leave a voice recording or other message if the potential prize winner does not answer Sponsor’s telephone call. The selected potential winner will be required to respond to the notification with the required information within five (5) business days of the date and time notification was sent/attempted by the Sponsor, or the Prize will be forfeited. To receive the Prize, the selected potential winner must continue to comply with these Terms & Conditions and fulfill all requirements set forth herein.
43. Selected potential winners may be required to sign and return an Affidavit of Eligibility and Liability & Publicity Release (“Affidavit”) and an IRS W-9 form to Sponsor. The IRS W-9 form will only be required if potential winner is a dual resident of Canada and the United States of America. If required by Sponsor, these documents will be sent out to the potential winners by email along with instructions on how to return them to Sponsor. In addition, each potential winner’s guest, if any, may (in sponsor’s sole discretion) be required to execute and return a release of liability as directed in order to participate in the prize as the winner’s guest. The selected potential winner may be required to provide their Canadian Social Insurance Number for tax purposes. Sponsor reserves the right to modify the notification and Affidavit procedures in connection with the selection of any alternate winner. Sponsor may share each potential winner’s name and contact information with Sweepstakes Entities and/or any prize provider, as applicable, if necessary. Upon completion and acceptance of the Affidavit, and once a potential winner provides the necessary proof of travel documents, if any, then he or she will be declared the winner.
44. PLEASE NOTE THAT EVEN IF YOU OR YOUR ENTRY IS IDENTIFIED AND/OR CONTACTED AS A POTENTIAL WINNER AT THE CLOSE OF THIS SWEEPSTAKES, YOU HAVE NOT YET WON A PRIZE. POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR AND MUST MEET ALL ELIGIBILITY REQUIREMENTS AND THE TERMS OF THESE TERMS & CONDITIONS BEFORE A PARTICIPANT WILL BE CONFIRMED AS A WINNER AND A PRIZE WILL BE AWARDED.
45. A selected potential winner may be disqualified (and may forfeit the prize) if such selected potential winner (i) is unreachable or does not timely respond to any communication from Sponsor (or its designee) (or if a winner notification is returned as undeliverable), (ii) declines or cannot accept, receive or use the Prize for any reason, (iii) fails to sign and return Affidavit within the required time period, (iv) fails to correctly answer the skill testing question, and/or, (v) does not comply with these Terms & Conditions. In the event that a selected potential winner is disqualified and/or is unable to satisfy the requirements herein, Sponsor will use reasonable efforts to award the Prize to an alternate winner selected from among the remaining eligible entries (if necessary and time permitting) who successfully meets the requirements to receive the Prize, but Sponsor reserves the right to not award the Prize if Sponsor is unable to identify an eligible alternate winner (if any) to accept the Prize.

PRIZES:

46. PRIZE: A total of Nine (9) Prizes are offered in this Sweepstakes (each “Prize”, collectively the “Prizes”). This Prize will be awarded to Nine (9) winners. This Prize consists of the following elements:

    $25,000 in cash.

Cash prizes will be provided in the form of withdrawable funds. Such withdrawable funds will not be subject to any withdrawal restrictions or expiration.

47. Prizes received from this Sweepstakes are non-transferable and are subject to availability (as determined by Sponsor in its sole discretion).
48. Estimated retail value (“ERV”) of the Prize is $25,000. Actual retail value (“ARV”) of prize may vary. Any difference between ERV and ARV will not be awarded.
49. All details of prizes will be determined by Sponsor in its sole discretion. Prizes are subject to certain terms and conditions as specified by issuer. Restrictions may apply. Prizes are not redeemable for cash except in Sponsor’s sole and absolute discretion.
50. Limit one (1) prize per person.
51. THE PRIZES ARE AWARDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE. SOME JURISDICTIONS MAY NOT ALLOW (OR MAY LIMIT) DISCLAIMERS OF CERTAIN WARRANTIES, IN WHICH CASE THE FOREGOING DISCLAIMERS WILL BE ENFORCED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
52. All details of the Prize will be determined by Sponsor in its sole discretion. Prizes are not redeemable for cash except in Sponsor’s sole and absolute discretion. Prizes are non-transferable and no substitutions will be made except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a Prize (or any element of a Prize) for one of equal or greater retail value. The value of Prizes set forth above represents Sponsor’s good faith determination of the Prize’s ARV, and the actual fair market value of the Prizes will be determined in Sponsor’s sole discretion and will be final and binding and cannot be appealed or otherwise challenged. Any federal, state, provincial, and/or local taxes (including income and withholding taxes) and all other costs and expenses associated with acceptance and use of the Prize not specified herein as being awarded are winner’s sole responsibility, including without limitation, ground transportation, luggage fees, meals, gratuities and souvenirs associated with the Prizes.
53. The Prizes are subject to certain Terms and Conditions as specified by the Sponsor. Restrictions may apply. Sponsor shall have no responsibility or liability for cancellations, delays, or any other change by any company or person providing any element of the Prizes and are not responsible or liable for any expenses incurred as a consequence thereof.
54. Notwithstanding anything to the contrary herein, stated on-air, published online, or otherwise communicated to a potential winner, no potential winner of will be entitled to receive the Prize until Sponsor has verified such potential winner’s eligibility and compliance with these Terms & Conditions and until such potential winner has completed and submitted all documents required by Sponsor.
55. In order to receive the Prize, the winner may be required to (i) present a valid photo identification issued by a commonwealth, province, state, or territory of Canada or by the Canadian federal government; (ii) provide or complete and sign any other documents required by Sponsor, including without limitation, one or more liability release agreements relieving Sponsor, its parent and affiliates and their respective officers, directors, members, managers, employees, agents, sponsors, prize provider and others from any and all liability with respect to the player’s participation in the promotion and the receipt and/or use of the prize.  Any person who refuses to present a valid government issued photo ID, to provide or complete and sign any other documents required by Sponsor by the deadline will forfeit any and all prizes.  Sponsor reserves the right to examine identification and may reasonably choose to accept or deny awarding the prize based on the identification presented.
